Terms of Service

Effective date: March 8, 2026

These Terms of Service ("Terms") govern your access to and use of the SafeSheet platform, including the website at safesheet.app and all associated services (collectively, the "Service"), operated by Elite Tech Global, LLC ("we," "us," or "our"), a Utah limited liability company. By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility & Account Registration

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organization. When you create an account, you agree to provide accurate and complete information and to keep your credentials secure.

Each account is associated with a single organization. The account owner is responsible for all activity that occurs under their organization's account, including actions taken by invited team members.

2. The Service

SafeSheet provides a cloud-based platform for managing Safety Data Sheets (SDS), chemical inventories, GHS-compliant labels, compliance checklists, and related workplace safety documentation. The Service includes QR code generation for employee access to SDS documents and audit logging for compliance purposes.

SafeSheet is a compliance management tool. We do not provide legal, regulatory, or safety consulting services. You are solely responsible for ensuring that your use of the Service meets the requirements of OSHA, GHS, and any other applicable regulations in your jurisdiction.

3. Subscriptions & Payment

Access to the Service is offered through paid subscription plans with varying feature limits. Subscription fees are billed monthly or annually, as selected at checkout, through our payment processor Lemon Squeezy.

All fees are non-refundable except as required by applicable law. We reserve the right to change our pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing cycle.

If payment fails, your subscription may be downgraded or suspended. You will retain read-only access to your data for 30 days after suspension to allow for data export.

4. Your Data & Ownership

You retain full ownership of all data you upload or create within the Service, including SDS documents, chemical records, compliance checklists, and audit logs ("Your Data").

You grant us a limited, non-exclusive license to host, store, process, and display Your Data solely as necessary to provide the Service to you. We will not access, use, or disclose Your Data for any purpose other than operating the Service, unless required by law.

You are responsible for ensuring that Your Data does not infringe on any third-party rights and that you have the necessary permissions to upload SDS documents and other materials.

5. Data Export & Portability

You may export Your Data at any time through the reports and download features available in the Service. Upon account closure, we will retain Your Data for 90 days to allow for export, after which it will be permanently deleted.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems
  • Upload malicious code, viruses, or any content designed to disrupt the Service
  • Use automated scripts, bots, or crawlers to access the Service without our prior written consent
  • Resell, sublicense, or redistribute access to the Service without our authorization
  • Deliberately submit false or misleading chemical safety information

We reserve the right to suspend or terminate accounts that violate these terms, with notice where reasonably practicable.

7. QR Code Access & Public Pages

The QR code feature generates public-facing pages that display chemical safety information to employees without requiring authentication. By using this feature, you acknowledge that the chemical names, manufacturers, hazard classifications, and SDS documents you publish will be accessible to anyone who scans the QR code or visits the URL.

You are responsible for the accuracy and completeness of safety information displayed through QR code pages. SafeSheet is not liable for injuries, damages, or regulatory penalties arising from inaccurate, outdated, or incomplete safety data that you publish through the Service.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We will make commercially reasonable efforts to notify you of planned maintenance in advance. We are not liable for any loss or damage resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Elite Tech Global, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total cumulative liability for all claims related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

SafeSheet does not guarantee regulatory compliance. The Service is a tool to assist you in managing safety data and documentation. Compliance with OSHA, GHS, and other regulations remains your responsibility. You should consult with qualified safety professionals and legal counsel regarding your specific compliance obligations.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will meet your specific requirements, that it will be error-free, or that defects will be corrected within any particular timeframe.

11. Indemnification

You agree to indemnify and hold harmless Elite Tech Global, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

You may close your account at any time through the account settings or by contacting us. We may terminate or suspend your account if you violate these Terms, fail to pay subscription fees, or if we discontinue the Service.

Upon termination, your right to use the Service ceases immediately. Sections regarding data ownership, limitation of liability, indemnification, and governing law survive termination.

13. Changes to These Terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes by email or through a prominent notice on the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in the State of Utah.
